Appeal Court Asked to Enforce Property Sale Agreement


A Nigerian-American engineer, Anthony Ugbebor, has appealed a Lagos State High Court judgment, urging the Court of Appeal to enforce a property sale agreement involving two luxury apartments in Victoria Island, Lagos.
Ugbebor is seeking to overturn the June 15, 2026 ruling, which held that the original agreement had been extinguished under the doctrine of novation and ordered the property developer to refund the N152 million he had paid.
In his appeal, the engineer argued that he fulfilled his contractual obligations by paying about 80 per cent of the agreed purchase price and maintained that the payment schedule was linked to construction milestones rather than fixed dates.
He is asking the appellate court to set aside the High Court’s decision, restore the validity of the sale agreement, and compel the developer to complete and hand over the two luxury apartments in line with the contract.
